Determining The Drug Defect

There are three general categories of drug injury claims, depending on the type of defect the drug has. Determining what drug defect harmed you is key in pinpointing who is liable for your health injury.

  • Manufacturing defect. If there was negligence in the manufacturing process, the drug may be inherently harmful. In such a case, it is likely the drug manufacturer that is held liable.
  • Dangerous side effects. There are drugs that were properly manufactured but create harmful side effects when taken by a person with a certain existing condition. Your doctor, pharmacist, or other healthcare provider should consider your health conditions before recommending any medical drug or device to you.
  • Improper marketing. “Marketing” here refers not just to advertisements but to labeling and instructions as well. When a drug is falsely advertised, inadequately labeled, or lacking crucial instructions, it can create harm to unknowing victims. The parties responsible for the packaging or marketing of the product may be held liable.

Examples Of Defective Drugs And Drug Injury Cases

You may have heard of injury victims suing pharmaceutical companies over the health issues that their drugs or medical devices have caused. Many drug companies have also been made to recall some of their products over the years after these products were found to be dangerous. Here are some examples of defective drug injury cases in Philadelphia and beyond:

Essure

Essure, a device developed by Bayer, is a non-surgical implant designed for female sterilization. It is placed inside a woman’s fallopian tubes to induce the development of scar tissue around it, blocking the tubes. Almost immediately after its release, many patients have complained about the device, claiming that it caused bleeding and intense pain.

Recently, federal judge John Padova in Philadelphia determined that one of the Essure lawsuits against Bayer has enough merit to proceed, despite the pharma giant’s motion for the case to be dismissed.

Risperdal

Risperdal is an antipsychotic medicine sold by Johnson & Johnson’s Janssen unit. There have been several observed side effects from this medicine, including diabetes mellitus and seizures. However, one of the biggest complaints about this drug is that it is linked to gynecomastia, or abnormal breast growth, which affects even male children and teens. Lawsuits have been filed over the emotionally scarring situation that the drug has caused.

In 2016, one of these lawsuits became a landmark case when a Philadelphia jury awarded $70 million to a male teenager who had abnormal breast growth. The jury decided that Johnson & Johnson’s failed to warn the young man and his family about the possibility that the drug could lead to such a condition.

Vaginal mesh

A transvaginal mesh is a net-like device that is surgically implanted through a woman’s vagina to treat urinary disorders such as pelvic organ prolapse and stress urinary incontinence. The device and the implantation method are prone to serious complications.

In one Philadelphia case, a woman claimed that the device, which she obtained from Johnson & Johnson’s Ethicon unit, brought her health problems and an inability to have sex. The jury awarded her $5.5 million as compensation plus $7 million as punitive damages (punishment) for Johnson & Johnson’s.
